Overview

Weston Hurd attorneys have a long history in representing the manufacturing sector in matters involving products liability, workplace intentional tort, workers’ compensation, labor relations, employment and general business matters.

In products liability litigation, the firm defends manufacturers and suppliers and insurers in claims pertaining to a variety of products from common household items such as dishwashers to industrial products like roofing systems.  Attorneys represent Ohio manufacturers who are sued by their employees for workplace intentional torts in matters such as: crushing and amputations from equipment, electrocutions, deaths and injuries from falls from and through roofs. The firm also represents manufacturers and suppliers in asbestos litigation.

In labor matters, attorneys advise manufacturers on services including:

  • Arbitrating grievances
  • Providing “union free” advice and counseling
  • Planning and managing union election campaigns
  • Collective bargaining advice and strategy
  • Strike planning and litigation
  • Representation proceedings and unfair labor practice proceedings before the NLRB

In employment matters, attorneys represent manufacturers during each phase of the employment relationship, including pre-employment testing, hiring, performance evaluations, discipline and discharge. If a manufacturer is faced with employment discrimination or wrongful termination matter, the employment attorneys deal constructively with administrative agencies and have been able to resolve such disputes without litigation. However, if an employment matter ends up in litigation, the attorneys have substantial trial experience, both jury and bench.

In the workers’ compensation area, Weston Hurd’s attorneys have extensive experience in defending employers’ interests in all aspects of employee-injury claims at the administrative agency level and in all of Ohio’s courts.

The firm also represents manufacturers in business and real estate matters including:

  • Advising a manufacturing company that has operations throughout the world.
  • Providing counsel on a $2.8 million asset sale of a fluid power equipment manufacturing company.
  • Counsel on the $10 million plus acquisition of commercial parcels, construction of manufacturing and warehouse facility and complex leasing arrangements in a build-to-suit leasehold transaction.
